They both legit might have a shot to win the case
this is the part that i hate about the process is because they dont tell everyone the details. nascar claims hendrick made unapproved modifications to the parts. they have talked about there being issues with the inconsistencies with these very parts all year. so my issue is how can it be proven if hendrick made the adjustments or the manufactor had a bad batch of parts. just because only hendrick got caught doesnt mean theres not 50 other ones from same batch of parts that arr illegal.
@Christopher Pope the system doesn’t work that way. There’s no “bad batches” of parts. Everything is cataloged documented, and photographed along every step. The parts aren’t released to the teams for assembly until Nascar inspects and documents them. HMS has no case, the parts are too strictly controlled.
@T L if thats true that nascar does inspect every single part before going to thr teams then your correct HMS doesny have a case .
They broke the rule as written. They shouldn’t win the appeal but I have no doubt it will at least be reduced because they are Hendrick.

@NHEHLERS That’s 8 parts that HMS received that were faulty. Kaulig received only two for the 31 car and not the 16.
@Crafton Fan I assume there isn’t a limit to how many each team can buy so perhaps Hendrick knows that variance of these parts is so great that buy buying a lot that you are bound to have more out of spec parts that may benefit you rather than hurt. perhaps rcr wasn’t on to this exploit

Sorry modern technology isn’t going to “out of spec” when I’m sure the for one the vendors have been vented for quality and I’m sure they are paid enough to ensure quality. If it spec and not stock then that’s what it is sorry. Just own you got caught red handed

I’m picking Justin Haley to win at Atlanta this week. There will be all the hoopla about a driver punching a ticket to playoffs even with having a negative amount of points. It’s a perfect headline for NASCAR.

@Josh Henderson You don’t have to. NASCAR did away with the top 30 points rule this year.
If he wins a race and not even any stage points he will still earn enough to take him out of the negatives. Just barely

With Kaulig being involved in this,we as fans might actually get more open and transparent information about these issues.
Maybe the Vendor knew they were out of spec parts and intentionally sent them to Hendrix to sabotage the Teams.
Why would Hendrick run them if they were bad? They knew they were bad, that’s why they asked NASCAR about them. They also didn’t have to run them, they obviously had at least 8 good ones (2 per car) to replace the bad ones. They ran them because they thought they could get away with modifying them to their advantage due to the bad manufacturing.
@Nick Mangona They obviously had 8 good ones on hand or they would have been DQ’ed after the race. If the parts were defective, you return them to the manufacturer.

I don’t think so too. My question is why would Hendrick modify part they knew they were supposed to touch regardless of the situation and I guess if you were already at the track I would ask around the Chevy Cruz they had extra that they could borrow or use for the race I don’t
@wingracer 16 this is West sister gonna get in trouble. Maybe they have enough validity with her saying to get the punishment lesson but if anybody just songs by Lil Boosie, they broke the wall.
Within minutes of the penalties being announced and nothing said about how the parts were “altered,” I threw out the possibility that the single source part was improperly manufactured. Now it’s being used as a main argument that they were given illegal parts per NASCAR standards by NASCAR’s own supplier. I got so much hate for asking simple questions.
It’s like going to an auto parts store to buy an alternator and the alternator is defective so you have to swap it out for another on. They were both made by the same company yet one was made properly and one wasn’t. It was bound to happen eventually if this is truly the case.
My question is why would they modify it knowing it was a part they weren’t supposed to touch once they realize I wasn’t doing anything. I would’ve asked around the other shop see if they had enough for they can let him have some . I think they can get a reduced penalty, but I think that’s it for the simple fact they did modify parts they weren’t supposed to change the light in the world.
@Jennifer Graham Kaulig had the exact same part that came straight from Nascar.
If the parts from the single supplier were incorrect then I think Hendrick has a case. If Hendrick modified the part then that’s on them.

Is it not strange that for the clash, Daytona, and Vegas they fit just fine but suddenly at the championship ending race track there suddenly not in “spec” anymore…… I’m not buying it. After the spanking Joey put on everyone they were definitely fudging parts to gain data for the final Pheonix race.
There is only a case if they have proof that they consulted NASCAR officials about the issue before modification
I think you’re going to see a reduction… But I don’t think they will go away completely. I think you’ll see points given back, but fines will stand.
Eric, please make a show called “motorsport court” to add to your lineup where you judge the calls made by nascar on various issues judge judy style

I strongly believe in both cases penalties will be reduced due to inconsistencies in communication and, importantly, the seizure of just a single louver from the Kaulig car.
If the penalties are upheld I hope they show what was wrong/modified on the louvers

They won’t, but they’ll change the rules to say hey if you get messed up parts of the manufacture and do this, I think that’s him right now trying to make is that they notify NASCAR mediately, but NASCAR kind of just left it open for possibility of miscommunication, but also why did you modify the part anyway knowing that you can get in trouble because he touched something according to the rules you weren’t suppose to touch

If NASCAR thinks they’re about to lose the appeal they’ll throw a caution flag right before the decision comes down.
I think that now HMS/Kaulig have a slight advantage over Nascar, considering it’s 2 teams arguing the same point as well as Kaulig having only one louver confiscated showing the inconsistency in parts received by the teams
I remember reading about and watching limited coverage of the Pikes Peak hill climb starting back in the 60’s. I’m 70 now. It was mi d boggling to think these guys could make it up that mountain in around 20 minutes or more. Not sure what they’re running now. Maybe 11, 12 minutes. Insane speeds and crazy cars, trucks and bikes. This thing takes skill and very large balls to get up that mountain. Great job Eric.

I feel like this is the problem that you are going to have when you have a single parts supplier. You could get a bad batch of parts or someone does not order the matching part.There are a variety of ways to make an appeal on this for the teams
