You can bet Hendrick Motor Sports is going to be under the microscope for a long time. NASCAR is going to have a tough time dropping the hammer on violations if all that happens is they get reduced. Other teams will not have much incentive to report any out of spec parts especially if they could give an advantage because they have a out now. NASCAR needs a better regime to check all these single source parts for being in spec before they go to the teams. That would take away that gray area that was exploited
As a William Byron fan, i absolutely love this result. Although i was VERY shocked that they reversed the penalties. HMS somehow finds ways out of some penalties……… or do they?
@Michigan Railfanner they didn’t bribe them. The reason why Hendrick modify them is because they literally couldn’t close the hood over the louvers. The manufacturers did such a crappy job making them that Hendrick had to literally go in and modify them just so they could fit. And the rule said you can’t modify, so that’s why they penalized them. From what I hear a lot of teams have been having issues with these parts not fitting correctly. It’s a win-win for NASCAR and Hendrick. NASCAR gets a half million dollars Hendrick get their points back.

The penalty were so ridiculously overblown , no way they all stick. They fact that they are pissed just goes to show the distain they have for RH and his team. I hope a Hendricks driver wins every race from now on..then gives NASCAR the middle finger. So ridiculous.
They checked all 4 hms cars but when Hamlin and Bush were penalized last season the other 2 Gibbs cars weren’t checked for the same alterations. NNASCAR is not consistent.

I agree with the appeals panel 100%. Eric, competition, modifications, and tweaks to the car here and there is embedded in the history of Nascar. It is integral to stock car racing as a whole. We don’t need the sanctioning body to be jumping down everyone’s throat the way they are trying to. Let the best minds win!
Eric, you were totally missing the boat on this one I believe… You have to remember that Hendrick motorsports was in communication with NASCAR on the parts, and even according to NASCAR themselves gave Hendrick permission to modify the parts so they would fit… NASCAR said that they went way too far and modified them to the point of being performance-enhancing, just not so they would fit… I think if Hendrick motorsports presented that, it would be very easy to see how they came up with the solution that they did… Because essentially NASCAR told them to go ahead and modify it, they might not have been clear in the intentions on how much they could… What I would like to know, Hendrick motorsports was claiming that the parts they received, did not match the CAD drawings that NASCAR approved, and they were just modifying the parts to match the CAD drawing… If that is true, the whole penalty should’ve been thrown out… That’s my two. Cents.

I think the argument to be made about regarding whether or not illegal parts were intended to be used in competition is that had they intended to straight up cheat, I don’t think they would’ve cooperated with the extra inspection process at the very beginning. Because they cooperated and seemingly acted in good faith, it is pretty hard to claim intent. I could be way off here but I feel that may have been a large factor in the panel’s decision.
5:30 Correct me if I’m wrong, but didn’t it also come out that the single source parts did not meet the agreed specifications when HMS received them. If Hendrick proved that and had bad communication from NASCAR, then maybe the appeals panel decided that giving the points back was the equivalent of penalizing NASCAR for their failures.
If I remember what I heard on the Dale Jr. Download correctly, HMS stated the louvers they were given were out of spec with what NASCAR approved for Chevys. Perhaps the appeal panel decided to rescind the points penalties because of the discrepancy, but decided to keep the fines and suspensions because HMS did violate the rules by modifying the single-source part to make it fit. I think Kaulig has a good chance in getting the same treatment, particularly since they stated only one of their louvers was confiscated.
I think the entire thing comes down to the Parts (Louvers) that were shipped to HMS by Nascar and it’s single source provider were junk and out of spec, so Hendrick HAD to modify them to make them fit to spec for the race.
I think that’s why the Independent Panel decided to give HMS the points back, because at the end of the day it’s Nascar’s responsibility for its Parts sources to make sure everyone in the garage is getting correct parts that are fit to spec
I agree. HMS might gone too far in the modification, but if they proved their modification matched the drawing, then the points being overturned was the right call.
As a Bowman fan, I’m very happy with the outcome of this. He’s back to being #1 in points and will hopefully carry momentum to the rest of the season.
It’s pretty interesting to me that NASCAR’s statement expressed their disappointment with the amended penalty. It makes me wonder how it will effect their dynamic with HMS for the remainder of the season.
Bill Lester was a Nascar truck series veteran in it’s early days. Glad to hear former drivers like him & Elton Sawyer are still in Nascar in more official roles.

Awesome for Josh Williams. Obviously HMS and NASCAR made good arguments. When everyone walks yet no one is totally satisfied, justice has been served

And it sounds like HMS did actually tell NASCAR before they got to the track maybe. If so, HMS never cheated at all.

wonder if Haley’s team will be able to get the same reduction or if there’s will be fully amended or if not at all. Will be interesting to see.
