In retrospect, this makes me wish FRM went through with their appeal and get McDowell that 100 points back (not that it would have mattered lol)

He wouldnt have won, hes not a hendrick driver

ForeverRanger 91 March 29, 2023 at 10:30 pm

FRM likely raced on those parts for multiple races.

Reply
Limp Rooster March 29, 2023 at 10:38 pm

FRM never actually intended to appeal the penalty. The next race was a road course and they thought they could win, so they filed an appeal so that they could keep their crew chief. Once the race was over they dropped their appeal

@ForeverRanger 91maybe, but their performance didn’t decline following that race, so I don’t think that they mattered for McDowell’s performance.

Well shoot. Seems as though Hendrick has been mighty clever with their negotiations and avoided the NASCAR death penalty. Major implications throughout the field are about to happen.

I’m predicting that they won’t win a title

@Rowdy BuschChase comes back in 2-3 weeks. They ran good with a first time driver in that car and back-up crew chief. I think they are still a huge threat.

It would’ve been interesting to be a fly on the wall during this hearing. I’m betting that Hendrick had a paper trail of emails, which helped.

The rule is what it is. Do not care they were caught before. They had all intentions of using them if they didn’t get caught. So Does nascar wait until after the fact or what. Don’t make sense to me

You can bet Hendrick Motor Sports is going to be under the microscope for a long time. NASCAR is going to have a tough time dropping the hammer on violations if all that happens is they get reduced. Other teams will not have much incentive to report any out of spec parts especially if they could give an advantage because they have a out now. NASCAR needs a better regime to check all these single source parts for being in spec before they go to the teams. That would take away that gray area that was exploited

RIP LaJoie’s playoff spot. Hope he can get it back; he deserves it after this season thus far.

Keep in mind he could win at Talladega, Atlanta or Daytona and still make the playoffs

@George Henry exactly my point.

As a William Byron fan, i absolutely love this result. Although i was VERY shocked that they reversed the penalties. HMS somehow finds ways out of some penalties……… or do they?

Reply
Michigan Railfanner March 29, 2023 at 11:11 pm

I like Byron too, and maybe larson but I mean cmon someone had to of bribed behind the scenes or something I mean WOW that’s not right

Reply
NoSoyAllowed March 29, 2023 at 11:16 pm

@Michigan Railfanner they didn’t bribe them. The reason why Hendrick modify them is because they literally couldn’t close the hood over the louvers. The manufacturers did such a crappy job making them that Hendrick had to literally go in and modify them just so they could fit. And the rule said you can’t modify, so that’s why they penalized them. From what I hear a lot of teams have been having issues with these parts not fitting correctly. It’s a win-win for NASCAR and Hendrick. NASCAR gets a half million dollars Hendrick get their points back.

Reply
Michigan Railfanner March 30, 2023 at 12:17 am

@NoSoyAllowed idk I just hate that like Harvick and NY personal favorite drivers try to overturn penalty and the appeals panel upholds them, meanwhile popular guys like the entirety of Hendrick with Elliott Larson etc get their points back I just hate that

Reply
Ribbs March 30, 2023 at 2:57 am

The penalty were so ridiculously overblown , no way they all stick. They fact that they are pissed just goes to show the distain they have for RH and his team. I hope a Hendricks driver wins every race from now on..then gives NASCAR the middle finger. So ridiculous.

Awesome for Josh Williams. Obviously HMS and NASCAR made good arguments. When everyone walks yet no one is totally satisfied, justice has been served

TIM REED March 30, 2023 at 12:27 am

They checked all 4 hms cars but when Hamlin and Bush were penalized last season the other 2 Gibbs cars weren’t checked for the same alterations. NNASCAR is not consistent.

Reply
TIM REED March 30, 2023 at 12:32 am

The parts were found prior to qualifying. They had no effect on competition.

Reply
PaulJr March 30, 2023 at 12:54 am

@Anubiam why yes they do

Reply
Jacob Evenson March 30, 2023 at 1:08 am

@TIM REED Dude you are comparing an entry inspection to a post race teardown (Post race teardown is ONLY done to the top 2 cars plus a random car in the field)… Not even remotely close to the same thing.

Reply
Ethan Mckinney March 29, 2023 at 10:57 pm

I agree with the appeals panel 100%. Eric, competition, modifications, and tweaks to the car here and there is embedded in the history of Nascar. It is integral to stock car racing as a whole. We don’t need the sanctioning body to be jumping down everyone’s throat the way they are trying to. Let the best minds win!

Reply
Douglas Hayes March 29, 2023 at 11:05 pm

Eric, you were totally missing the boat on this one I believe… You have to remember that Hendrick motorsports was in communication with NASCAR on the parts, and even according to NASCAR themselves gave Hendrick permission to modify the parts so they would fit… NASCAR said that they went way too far and modified them to the point of being performance-enhancing, just not so they would fit… I think if Hendrick motorsports presented that, it would be very easy to see how they came up with the solution that they did… Because essentially NASCAR told them to go ahead and modify it, they might not have been clear in the intentions on how much they could… What I would like to know, Hendrick motorsports was claiming that the parts they received, did not match the CAD drawings that NASCAR approved, and they were just modifying the parts to match the CAD drawing… If that is true, the whole penalty should’ve been thrown out… That’s my two. Cents.

I’m confused I thought that Hendrick said that they did not touch the parts.maybe I missed something along the way mind you I’m on Hendrick side because the amount that they were fined was way too high I’m thinking maybe nascar needed some extra funds and decided Hendrick could pay.

Reply
Brock Consalo March 30, 2023 at 4:19 am

@Janet Hart that was Justin Hayley car that said they didn’t touch anything

Reply
Brandon Andrews March 29, 2023 at 11:12 pm

I think the argument to be made about regarding whether or not illegal parts were intended to be used in competition is that had they intended to straight up cheat, I don’t think they would’ve cooperated with the extra inspection process at the very beginning. Because they cooperated and seemingly acted in good faith, it is pretty hard to claim intent. I could be way off here but I feel that may have been a large factor in the panel’s decision.

TNLuke Buckeyes March 29, 2023 at 11:17 pm

5:30 Correct me if I’m wrong, but didn’t it also come out that the single source parts did not meet the agreed specifications when HMS received them. If Hendrick proved that and had bad communication from NASCAR, then maybe the appeals panel decided that giving the points back was the equivalent of penalizing NASCAR for their failures.

Reply
Easy E Network March 30, 2023 at 1:24 pm

And it sounds like HMS did actually tell NASCAR before they got to the track maybe. If so, HMS never cheated at all.

Reply
sapphirerocket March 29, 2023 at 11:30 pm

If I remember what I heard on the Dale Jr. Download correctly, HMS stated the louvers they were given were out of spec with what NASCAR approved for Chevys. Perhaps the appeal panel decided to rescind the points penalties because of the discrepancy, but decided to keep the fines and suspensions because HMS did violate the rules by modifying the single-source part to make it fit. I think Kaulig has a good chance in getting the same treatment, particularly since they stated only one of their louvers was confiscated.

I think the entire thing comes down to the Parts (Louvers) that were shipped to HMS by Nascar and it’s single source provider were junk and out of spec, so Hendrick HAD to modify them to make them fit to spec for the race.

I think that’s why the Independent Panel decided to give HMS the points back, because at the end of the day it’s Nascar’s responsibility for its Parts sources to make sure everyone in the garage is getting correct parts that are fit to spec

Reply
Easy E Network March 30, 2023 at 1:30 pm

I agree. HMS might gone too far in the modification, but if they proved their modification matched the drawing, then the points being overturned was the right call.

Reply
Alan Wiltsie March 30, 2023 at 1:47 am

Definitely got the call right imo. I’m glad they got the points restored.

As a Bowman fan, I’m very happy with the outcome of this. He’s back to being #1 in points and will hopefully carry momentum to the rest of the season.

It’s pretty interesting to me that NASCAR’s statement expressed their disappointment with the amended penalty. It makes me wonder how it will effect their dynamic with HMS for the remainder of the season.
