UPDATE: Hendrick Motorsports will appeal the penalty, saying the louvers they were provided did not meet specs and were not actually used in the race. They also say they received inconsistent communication from NASCAR relating to the louvers.

Do think their appeal will be successful?

Fines will go up but the third party will drop the point penalties and suspensions

Most definitely. It’s kind of the same situation that happened to Brad last season. Got hit with a very early massive penalty, and it took them all season to finish in the top 25. Haley definitely has more speed than RFK had last year at this point, so it’s not completely hopeless.

Reply
Eric Pedersen March 15, 2023 at 7:15 pm

Yes. I wonder if they could appeal saying – we got the louvers from Hendrick and they were already modified. We had not reason to check them. Not our fault. Maybe at least a reduced penalty.

@draneym2003  he wasn’t racing, and is already losing points for being out. What conspiracy are yall always trying to make?

Reply
ctgrfgh22 March 15, 2023 at 6:13 pm

The main one I’m worried about is Bowman. He was literally leading the points just on consistency, and now this could have ruined his playoff hopes unless he wins. I’m hoping Hendrick’s appeal gets approved, because they have just been great, including at Vegas a couple of weeks ago.

You’ve also gotta feel bad for Justin Haley. I have never seen a driver with -40 points.

bowman will easily win a race soon. i really love how him and byron are lookin

Reply
ALieN_iNC March 15, 2023 at 7:22 pm

@James Blunt and they would get caught and ruin their seasons too?

Reply
Daniel Matthew Vasquez March 15, 2023 at 7:27 pm

@ALieN_iNC as a sanctioning body they can’t disclose exactly what they found or what exactly hendrick did to the part bc then that opens the door for misinterpretation / manipulation from other teams going forward & i’d like to think they’re not trying to go on a fine parade this season. That’s not a good look for the sport. Hence, the unknown subconsciously deters teams from even attempting it

Nascar should really do a show and tell providing public evidence of the modification they claim was made.

Red Mac March 15, 2023 at 8:17 pm

Face it Hendrick motorsports is a cheating company

Reply
PotPi March 15, 2023 at 8:22 pm

They won’t, because they know the parts were bad to begin with but won’t admit it

Reply
Easy E Network March 15, 2023 at 8:46 pm

I think it was broken into 3 instead of one piece maybe to fit better. Don’t think they covered the opening, but it could have maybe narrowed the opening, which would create more downforce, but this was not used at other tracks since it would have been caught at Daytona. I have a feeling it was a modification to make it fit.

Reply
Jason S March 15, 2023 at 8:53 pm

Search on here for Elton Sawyer’s (Nascar competition director) comments. He said that the modifications made were not approved and that it was “obvious” what the Hendrick teams did was beyond what was allowed.

Reply
PotPi March 15, 2023 at 8:56 pm

@Jason S That’s only because it’s a single-source part, which you can’t modify *at all*. Imo that’s a word trick to make it seem like HMS did something absurd, rather than just… Trying to make the crappy parts fit.

And no, they weren’t approved. That’s because HMS tried to communicate with them and NASCAR didn’t communicate well in return. That’s one of the bullet points in the HMS appeal

Alexis Te2r March 15, 2023 at 6:50 pm

as a fan of Alex Bowman we will never know the happiness he is consistent and more he first in the championship for the first time in his career. and justin haley goes from 60 to -40 it’s brutal I hope Kauling will also appeal especially since it’s weird there’s only one car out of the two that had the parts confiscated

I just don’t understand why they would take a risk like this, especially when they already had speed. How did that work out for them?

Eric, kudos for being fair when it comes to penalty announcements. Your neutral approach to reporting on these issues is great…thank-you.

You can kind of tell hes pretty biased in a lot of areas when it comes to certain stuff if you have good attention to detail. He basically hates any Chevy or Toyota and is a big fan of fords, Penske and RFK. He brings up BK way too much for how irrelevant he is in the sport.

Reply
Memo Licious March 20, 2023 at 8:02 pm

Rodolfo Soto March 15, 2023 at 8:50 pm

I honestly don’t get why or how HMS came to this situation? Did they think Nascar would treat them differently, or thought the modification was lawful? Beats me! that’s why I believe fans deserve to know more about this and past severe penalties.

I’m an HMS fan and totally agree. Not racing with the parts makes me think….will they win the appeal?

Reply
Justin Moore March 16, 2023 at 2:45 am

They were given the parts and they didn’t fit so they modified them

Reply
Devin C March 16, 2023 at 3:23 am

It’s just Tricky Rick Hendrick at it again. He’s not new to trying to manipulate things to benefit his team even more. Them cheating chevies…

Reply

@Devin C let’s face it man every team no matter the manufacturer cheats

Reply
Jared Champagne March 16, 2023 at 4:27 am

@Devin C EVERY SINGLE nascar team bends the rules. If you aren’t trying to bend the rules, you are not winning in NASCAR, this is well documented among retired drivers…

Reply
Matt J March 15, 2023 at 10:58 pm

When you’re running that much faster than the whole field, and it’s consistent in all 4 cars, the rules folks are going to go over everything with a fine toothed comb…kinda bad on Hendrick to get caught on something like this, since it’s so obvious. I know they say NASCAR didn’t communicate clearly (no doubt they’re right about that), but they have been pretty consistent about hammering any team that makes any changes to parts.

What did NASCAR miss while focusing on the hood louvres?

Reply
Ian Uecker March 15, 2023 at 11:50 pm

So I think the thing that hurts Hendrick the worst is the loss of the Crew Chiefs. The Crew Chief driver combos are some of the best in the cup series. The drivers losing them hurts them the worst in my opinion.

Reply
Andy Anglin March 16, 2023 at 3:08 am

If Rick or Jeff new about this beforehand then shame on them for putting those teams in that position. If they didn’t know then someone needs to be fired

Reply
CastandBlast March 16, 2023 at 5:40 am

Bigger question for competition wise: is this new spec car better for on track product?? And while speaking of the car- if you have the capability of making the next gen so much better lemans, why not incorporate most of those changes now?

Reply
Upright Fossil March 17, 2023 at 9:21 am

That’s brutal indeed. Seems they still need to get ahead driver aggression as well. Still waiting on losing points for the following season ob deliberate crashes.

Reply
JD Wht March 17, 2023 at 1:56 pm

Makes ya wonder if they had those louvers the entire short so far season with the speed that they had. Oh and Byron’s win – Harvick’s crew chief “gave” that to Byron with a slow four tire stop that Kevin couldn’t overcome vs a 2 tire stop that Byron made. That’s what happens all too often with an overtime race and one of the reasons I still watch these races.
