Screw this, I’m done with NASCAR. This is stupid. I’m a Hendrick fan but I can’t. It’s the same penalty but the bigger guy gets away with it.
Not even the same penalty!!! If HMS Was fined for having both vents per car… Kaulig only had 1! Ideally they should have initially received 1/2 of the penalty to begin with.
As for there being “No Transparency” all we can do is assume the appeals panel of is being biased! Even the supreme court of America releases it’s final judgement on a case… But not here in Nascar?!

Agreed. Hendricks said it was Chastain’s fault and Kaulig didn’t use that argument. Hence the decisions.

Yeah NASCAR has to add something to the rule book to where you can’t make appeals or go to the appeals panel. This outrage from me and other fans has gotten out of control, and there needs to be a solution so they don’t lose credibility.
Why have an appeals panel if you cant use it? You do know that the panel is used in every form of motorsports. And is made up of 35 different people from all types of motorsports. So if a team in Indy or any other form of racing in America needs to appeal something, it goes to the very same panel of people.
You can’t give NASCAR that much power. The fandum already goes after NASCAR for just about everything. Why give them one more reason? Being Judge, Jury, and Executioner is far too much power. The only way to get away from this stuff is for NASCAR to have a range of penalties. The minimum can be 100 points and the max is 200 points. But it can’t be appealed lower than 100 points. Now NASCAR would have to change the rule book for that but is just another can of worms to open that doesn’t need opening.
NASCAR cant have power like that, they’re getting harsher with it and at this point seemingly are just handing out penalties to Hendrick for no other reason than spite

Now that the charters are set and they’ve appreciated so much in value, it would be a huge hit to the teams that paid dearly for their charter, if the system was ended.
That would also lead to so many people leaving if NASCAR did that. Michael Jordan is definitely gone if they decided to do away with charters.
Nascar would likely be sued because throwing away he charter system after everyone already paid in would likely be considered fraudulent in some way.
@Marco Strange Yes. Now that it is (unfortunately) set in stone, they can’t let it go. Too many teams have invested too much money.
Charters never should been started to begin with. The teams should be responsible for their car getting in the race, not the series.
The only way NASCAR could get away with ending the charter system is to pay the team owners the current market value of each charter they own, but there’s no way they can afford that. And unfortunately, sponsors love the charter system. It’s a lot easier to get companies on board if there is a guarantee that their driver will be in the race. You won’t find many companies today willing to put money into a team and have their only exposure be for two laps in qualifying.
Kaulig didnt modify their part, they get their parts from Hendrick. This is friggin absurd, allegedly they dont even have the tools to modify the louvers
They dont get it from hendricka. All teams get it from a single source supplier…
They all get their parts from the same single source supplier so Kaulig couldn’t have gotten them from Hendrick. And the fact that it was only one Kaulig car makes me believe theirs was either intentional or the single source supplier provided them to both Hendrick and Kaulig modified. Faulty parts do happen. That’s where Nascar’s bad communication comes into play if Hendrick either wasn’t told if they could use them or if Nascar told them they could use them and then decided they couldn’t. Either way this is a circus and I blame Nascar either way for this.
Even if the louvers were being received through a technical alliance and not direct from manufacturer, Kaulig’s TA is with RCR, not HMS
The charter system should be permanent but who has the charters should not. It should be performance based like bottom two every season. Go up for auction or something along those lines to allow new more competitive teams to purchase a charter and to weed out the back markers that do not intend to get better

Sorta like when the top 35 were locked In qualifying why would any team spend 15-20 million just to loose it at the end of the season makes no sense all the small teams would just loose their charters and all this bs with cost cutting to even the field would have been for nothing nascar has become like every other large corporation cares nothing for what the consumer wants just about making money
Get rid of it, it should be on time. Like it used to be.
The problem with the loss of the charter system is that when a team has to close down the team is basically worthless! Parts and equipment is sold for pennies on the dollar and you leave the sport with less than you came in with! Having a charter to sell to a new team gives the team some value!
I think the teams must finish no lower than 35th in points to keep their charter (I thinks there’s a current rule of 2 years of consistent)… And the remaining 5 spots are allowed for open qualifying. I do think they need to go back to 43 cars allowed on the track assuming they can make a speed/time better than the minimum requirements.
This is why I don’t think Junior Motorsports can make the jump to Cup because of the uncertainty in the charters. I do however think that without the Charter system in place they already would be in Cup?
Yeah, it’s fishy how the appeal’s panel lets Hendrick get away with it and not Kauling. Besides, who are these mysterious appeal panels? They should leave Nascar be.
Nascar needs to brings out the parts that were taken and shown what was done to these parts. Now it’s unfair to say Hendrick has more power on this, because this is an independent board that doesn’t have an affilation with Nascar and the people who hear the appeals are different every time. I’m interested to here what they think of Hamlin’s appeal today. There neeeds to be severe transparency at this point and Nascar needs to do something about Fox’s coverage of the races, because they suck. Mike Joy was a great announcer, but it’s time to retire. He has lost the pulse of the fans
I didn’t believe the Hendrick Motorsports being favorited argument people have made, but at least on the surface, this is what it looks like is happening…
I wish we could know specifically what the arguments made by both Hendrick and Kaulig were, so that we could perhaps understand why Hendrick got their penalties largely rescinded, while most of the penalties from Kaulig were kept in place.

I think the charter system is a fine line to walk. Yes you want new teams to compete, but you also want the teams who have been there to be happy too. Maybe have a kind of lottery, or something, where there are X amount and some are given away by performance based and others pure luck, every team puts up X $$ to be in the draw…. but what do I know lol
I just want to see more newer teams and have the sport thrive.
Welp that sucks for Kauling really makes no sense at all how Hendrick got away with it but they didn’t it’s so confusing. However, I just saw on Twitter than Hendrick got an L1 Penalty for the 24 and 48 for another modification. That’s gonna be an interesting one.
They’ll appeal and get that overturned as well
I want full disclosure on all penalties. Now that nascar “randomly” selected the 24 and 48 to go to R&D and hit them with a fine no one understands what it is. I’m fine with if they’re cheating that get a fine, this one seems like blatant revenge.
The charter system needs a tiered model. Something like 20-25 “lock in” charters that guarantees a spot in every race, and another 25 or so charters don’t have guaranteed spots. That would allow new teams to get in a little easier and almost guarantee the ability to go back to 43 entries every weekend.
We the fans, deserve more. NASCAR should open up the appeals panel to the public.
See if any past or present appeal member is willing to share about the process (who and how people are selected on the board or in specific appeals). And see if they’ve ever disagreed with the decisions of any panels etc. obviously they will not be able to add specifics but maybe someone can speak about it procedurally. I’ve always like to hear more about them as it is always so secretive.
UPDATE: NASCAR just amended parts of the rulebook. Going forward, they will be allowed to publish the Appeal Panel’s reasoning.

They also said earlier on race hub that regardless of the outcome of the appeal decision you lose points anyway and that was the reason that Kaulig still lost points ! The rule was made the day before Kaulig appeal hearing !

Great episode, Eric. The current NASCAR regime desperately wants to return to the days of Big Bill France where they could just tell everyone what to do and they would do it. It’s a different world these days and they’re never going to achieve that, but they sure would love to.
