Kyle Busch was scheduled to race twice over Memorial Day weekend. He was first scheduled to race in the Truck Series race at Charlotte Motor Speedway on Friday, before racing in the Coca-Cola 600 on Sunday. It was declared he would be out of the races, and then Busch passed away on Thursday at the age of 41.
Considering he was a late pull, Busch was available to be bet on all week, heading up to the truck race, originally scheduled for Friday. The race was postponed until Sunday morning, and many were disappointed when DraftKings declared their Kyle Busch bets as a loss, per Clay Sauerteig of BroBible.

The bet in question was posted by X user SkyboxNASCAR and showed a $20 bet on Kyle Busch to win the race. It was also graded as a loss, despite the tragic circumstances.
“Some have reached out and said DK that they are ‘betting on the 7 truck.’ The rules say nothing about the truck; if so, they would be graded Josh Berry replacement bets as winners,” one fan replied.
“Nasty work from DK, but this shows you exactly who they are as a company,” wrote another.
DraftKings is seemingly standing behind their house rules, despite the situation, as another user posted a reply from the company’s customer support.

By the rules, this wager has correctly settled as a Loss. Corey Day drove the No. 7 car in place of Kyle Busch, and per NASCAR settlement rules, when multiple drivers participate in the same car, bets on each driver are settled based on the final result of that car. Corey Day Lost. Kyle Busch Lost. The No. 7 car finished 35th, so that result applies to both drivers. I am fully aware of the situation with Busch, but by our rules, we are not able to void any wagers placed on him since his car was still ran during the race.”
DraftKings could still retroactively void the bets and refund customers, but until then, customers will have to accept the loss. That is the risk with gambling, but this may be an extenuating circumstance.
